1. Acceptance of Terms

By making a booking, accessing our website, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

We reserve the right to modify these Terms at any time. Changes will be posted on our website with an updated "Last Updated" date. Continued use of our services after changes constitutes acceptance of the modified Terms.

If you do not agree to these Terms, you must not use our services.

2. Services Provided

West Coast Surf Morocco offers the following services:

• Surf lessons and coaching for all levels
• Surfboard and wetsuit rental
• Accommodation at our surf camp or partner properties
• Transportation to and from surf spots
• Yoga and wellness activities
• Cultural excursions and additional activities

All services are subject to availability and may be modified or canceled due to weather conditions, safety concerns, or other circumstances beyond our control.

3. Booking and Payment

3.1 Reservations

All bookings must be made through our website, email, or phone. Bookings are confirmed only upon receipt of the required deposit or full payment.

We reserve the right to refuse any booking at our discretion.

3.2 Payment Terms

• A non-refundable deposit of 30% is required to secure your booking.
• The remaining balance must be paid in full at least 30 days before your arrival date. Bookings made within 30 days of arrival require full payment at the time of booking.
• Payments can be made via bank transfer, credit card, or other approved payment methods.
• All prices are quoted in Euros (EUR) or Moroccan Dirhams (MAD) and include applicable taxes unless otherwise stated.

3.3 Price Changes

Prices are subject to change. However, once a booking is confirmed and deposit received, the price will not change unless you modify your booking.

4. Cancellation and Refund Policy

4.1 Cancellation by Guest

• Deposits are non-refundable under all circumstances.
• Cancellations made more than 30 days before arrival: Refund of any payments made beyond the deposit, minus a 10% administrative fee.
• Cancellations made 15-30 days before arrival: 50% refund of payments made beyond the deposit.
• Cancellations made less than 15 days before arrival: No refund.
• All cancellations must be made in writing via email.

4.2 Cancellation by West Coast Surf Morocco

We reserve the right to cancel bookings due to insufficient enrollment, weather conditions, safety concerns, or other unforeseen circumstances.

In the event of cancellation by us, you will receive a full refund or the option to reschedule to alternative dates.

We are not liable for any additional expenses incurred, including flights, transportation, or accommodation booked independently.

4.3 Travel Insurance

We strongly recommend purchasing comprehensive travel insurance that covers cancellations, medical emergencies, accidents, and equipment loss or damage.

5. Guest Responsibilities

5.1 Health and Fitness

• You must be in good physical health and capable of participating in surfing and related activities.
• You must disclose any medical conditions, injuries, or physical limitations that may affect your ability to participate safely.
• You must be able to swim at least 50 meters in open water.
• Pregnant guests must provide written medical clearance from their doctor.

5.2 Conduct

• You agree to behave respectfully towards staff, instructors, other guests, and local communities.
• You must follow all instructions from our staff and instructors, especially regarding safety procedures.
• Disruptive, threatening, or illegal behavior will result in immediate termination of services without refund.
• Drug use is strictly prohibited. Alcohol consumption must be moderate and responsible.

5.3 Equipment Care

• You are responsible for the safekeeping of any equipment provided to you.
• You will be charged for any loss or damage to equipment beyond normal wear and tear.
• Equipment must be returned clean and in the condition it was provided.

5.4 Personal Belongings

You are solely responsible for your personal belongings. We are not liable for any loss, theft, or damage to personal items.

6. Liability and Risk

6.1 Assumption of Risk

Surfing and water sports are inherently dangerous activities that carry risks of injury or death.

By participating in our activities, you acknowledge and accept these risks voluntarily.

Risks include but are not limited to: drowning, impact injuries, cuts, bruises, sprains, fractures, head injuries, spinal injuries, encounters with marine life, and exposure to weather elements.

6.2 Limitation of Liability

• To the maximum extent permitted by law, West Coast Surf Morocco, its owners, employees, instructors, and affiliates shall not be liable for any injury, illness, death, loss, or damage arising from your participation in our activities.
• We maintain appropriate safety equipment and follow industry-standard safety protocols, but we cannot guarantee your safety.
• Our liability for property damage is limited to the actual cost of repair or replacement, up to a maximum of EUR 500.
• We are not responsible for delays, cancellations, or changes to activities due to weather, ocean conditions, or other circumstances beyond our control.

6.3 Indemnification

You agree to indemnify and hold harmless West Coast Surf Morocco from any claims, demands, losses, damages, or expenses (including legal fees) arising from your breach of these Terms or your participation in our activities.

7. Medical and Emergency

• You authorize us to arrange medical treatment in case of emergency.
• You are responsible for all medical expenses incurred, including emergency evacuation.
• You must provide emergency contact information and notify us of any allergies or medical conditions.
• We maintain basic first aid supplies and staff trained in emergency response, but we are not medical professionals.

8. Photography and Media

• We may take photographs and videos during your stay for promotional purposes.
• By participating in our programs, you grant us permission to use such media on our website, social media, and marketing materials.
• If you do not wish to be photographed or filmed, please notify us in writing at the time of booking.
• You retain the right to request removal of specific images at any time.

9. Accommodation Terms

• Check-in is typically at 2:00 PM and check-out at 11:00 AM, subject to availability.
• Rooms are allocated based on availability and booking type. We reserve the right to assign rooms at our discretion.
• You are responsible for any damage to accommodation or property beyond normal wear and tear.
• Smoking is only permitted in designated areas.
• Quiet hours are from 10:00 PM to 7:00 AM.
• Guests are not permitted to bring visitors onto the premises without prior approval.

10. Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to: natural disasters, severe weather, pandemics, government restrictions, war, terrorism, strikes, or equipment failure. In such cases, we will work with you to reschedule or provide alternative arrangements where possible.

11. Minors

• Minors (under 18) must be accompanied by a parent or legal guardian, or have written parental consent.
• Parents or guardians are responsible for supervising minors at all times outside of scheduled activities.
• Minimum age for surf lessons is typically 8 years old, subject to instructor assessment.

12. Privacy and Data Protection

• We collect and process personal information in accordance with our Privacy Policy and applicable data protection laws.
• Your information will be used solely for booking purposes, service delivery, and communication.
• We will not share your information with third parties except as necessary to provide services or as required by law.

13. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of West Coast Surf Morocco and protected by intellectual property laws. You may not reproduce, distribute, or use any content without our written permission.

14. Governing Law and Disputes

These Terms are governed by the laws of Morocco.

Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Morocco.

We encourage resolution of disputes through direct communication. If you have a complaint, please contact us immediately so we can work to resolve it.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any booking confirmation, constitute the entire agreement between you and West Coast Surf Morocco and supersede all prior agreements and understandings.
